On April 7, 2017, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register a Notice of Proposed Rulemakings for Infant Incline Sleep Products (16 CFR 1236).
Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the United States Consumer Product Safety Commission (Commission or CPSC) to promulgate consumer product safety standards for durable infant or toddler products. These standards are to be ‘‘substantially the same as’’ applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product. The Commission is proposing safety standards for Infant Incline Sleep Products in response to the direction under Section 104(b) of the CPSIA.
An infant incline sleep product is defined as a freestanding product, intended to provide a sleeping accommodations for an infant up to approximately 5 months of age, that is generally supported by a stationary or rocker base with one or more inclined sleep surface positions for the seat back that are greater than 10° and do not exceed 30° from the horizontal.
The CPSC staff recommends adopting the requirements specified in ASTM F3118-17, Standard Consumer Safety Specification for Infant Incline Sleep Products, with one modification to the standards definition for “accessory”.
Public comments on the Infant Incline Sleep Products NPR may be submitted up to June 21, 2017.
